These Terms and Conditions (“Terms”) apply when you use simcore.com.au or buy products from SimCore Pty Ltd (ABN 97 643 528 634) (“SimCore”, “we”, “us”, “our”). By placing an order, you agree to these Terms. Please also read our Shipping, Payments & Returns page and our Privacy Policy, which form part of these Terms.
Your rights under the Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot be excluded.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
In plain terms:
- Major failure: you can choose a refund or a replacement (or, in some cases, compensation for the drop in value).
- Minor failure: we may choose to repair, replace or refund. If we don’t fix it within a reasonable time, you can get it fixed elsewhere and ask us to cover reasonable costs, or treat it as a major failure.
- These rights apply regardless of any warranty we offer, and in addition to it.
About these Terms
- Who we are: SimCore Pty Ltd, 31 Rickard Rd, South Hurstville NSW 2221, Australia. Email info@simcore.com.au, phone +61 467 982 266.
- Changes: we may update these Terms from time to time. The version on this page when you place your order applies to that order.
Products and descriptions
We make every effort to describe and photograph our products accurately. Colours, finishes and sizes may vary slightly from images. Many of our products are designed for use with third-party wheelbases, pedals and software; please check compatibility on the product page or contact us before ordering.
Some products are made to order or customised using the options you select. Please check your selections carefully, as custom items are made to your specification.
Prices
- Prices on our website are listed in US dollars (USD) and exclude GST.
- You can choose to view and pay in USD or Australian dollars (AUD) using the currency selector. AUD amounts are converted at our current exchange rate.
- You will be charged the amount, and in the currency, shown at checkout.
- For orders delivered within Australia, GST (10%) is added at checkout, including on shipping. The GST amount is shown separately before you pay.
- Orders delivered outside Australia are not charged Australian GST, but may attract import duties and taxes in your country (see “Shipping and delivery” below).
- Your bank, card issuer or PayPal may charge its own currency conversion fees.
- Shipping costs are shown at checkout before you pay.
- If a product is listed at an obviously incorrect price because of an error, we will contact you before processing the order and you may choose to proceed at the correct price or cancel for a full refund.
Orders and acceptance
- Your order is an offer to buy. A contract is formed when we accept your order, which happens when we send you an order confirmation email after payment is received.
- We may decline or cancel an order (for example, if a product is unavailable, there is a pricing error, or we suspect fraud). If we do, we will refund any amount you have paid in full.
- Pre-orders: where a product is offered on pre-order, the estimated dispatch date is shown on the product page. Estimates can change; we will keep you informed of delays. You can cancel a pre-order at any time before the item has shipped by contacting us, and we will give you a full refund.
Payment
- We accept payment by PayPal (including cards processed through PayPal where available) and direct bank transfer.
- Bank transfer orders are processed once cleared funds are received in our account.
- Payment must be received in full before we dispatch your order.
- We do not store your card details. PayPal payments are processed securely by PayPal.
Shipping and delivery
- We ship within Australia and to most countries worldwide. Delivery options and estimated times are shown at checkout. Timeframes are estimates only; international delivery with Australia Post can take 2–3 weeks or more.
- Risk in the goods passes to you on delivery. Ownership passes to you once we have received full payment.
- International orders: you are responsible for any import duties, taxes (such as VAT), tariffs, brokerage and customs charges in your country. We will not under-declare the value of goods or mark orders as gifts. If a parcel is refused or returned because these charges are not paid, return shipping and any charges incurred may be deducted from any refund.
- If your order arrives damaged or you receive the wrong item, please contact us as soon as possible with photos so we can fix it.
Full details are on our Shipping, Payments & Returns page.
Change of mind returns
In addition to your ACL rights, we offer change-of-mind returns on most items:
- Tell us within 14 days of receiving your item, then return it within a further 14 days.
- Items must be unused, in original condition and packaging, with proof of purchase.
- You pay return shipping for change-of-mind returns. We recommend a tracked, insured service.
- Custom builds (made-to-order or customised items) cannot be returned for change of mind. This does not affect your rights under the Australian Consumer Law if the goods are faulty.
Change-of-mind returns do not affect your rights if a product is faulty.
Faulty products and warranty
- We provide a 12-month warranty on our products against defects in materials and workmanship, unless stated otherwise in the product documentation. This warranty is in addition to your rights under the ACL.
- How to claim: contact us at info@simcore.com.au or +61 467 982 266 with your order number, a description of the problem and photos or video where possible. We may ask you to return the item for assessment.
- Shipping costs: subject to your rights under the Australian Consumer Law, you pay the cost of sending a faulty item to us, and we pay the cost of shipping the repaired or replacement item back to you.
- If an item cannot be returned without significant cost (for example, because of its size or how it is installed), we will arrange to collect it at our cost.
- Under the ACL, you can also claim reasonable costs resulting from a failure, such as reasonable return shipping costs for a valid claim.
- The warranty does not cover damage from misuse, accidents, modification, incorrect installation, or normal wear and tear.
- Repairs not covered by warranty are quoted on a case-by-case basis.
Limitation of liability
To the extent permitted by law (including the ACL):
- we are not liable for any indirect or consequential loss arising from your use of our products or website, except for loss that was reasonably foreseeable under the ACL consumer guarantees; and
- where goods are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a consumer guarantee is limited to replacing or repairing the goods (or paying the cost of doing so), as permitted by section 64A of the ACL.
Nothing in these Terms limits our liability for anything that cannot be limited by law.
Using our website
You must not misuse our website, attempt to gain unauthorised access, or interfere with its operation. Content on the site, including product designs, images, manuals and software tools, is owned by or licensed to SimCore and may not be copied for commercial use without our permission.
Privacy
We handle your personal information in line with our Privacy Policy.
Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
